What is the "Startup Law"?

Passed in late 2022, Ley 28/2022 changed the landscape for remote workers. Unlike the NLV (Non-Lucrative Visa), the Digital Nomad Visa explicitly authorizes you to work. It bridges the gap between being a tourist and a traditional local employee.

Eligibility Requirements 2026

Remote Employment

You must work for a company (or clients) located outside of Spain for at least 3 months prior to applying.

Financial Stability

Proof of income totaling 200% of the Spanish Minimum Interprofessional Wage (SMI). Approx €34,188/year (2026 SMI).

Education/Experience

Must have a University degree/Professional certificate OR 3 years of experience in your field.

Clean Record

National background check from any country where you lived in the last 5 years with Apostille.

The Application Roadmap

Documentation Phase

Assemble contracts, apostilles, and translation. Pro tip: Foreign documents must be translated by a sworn Spanish translator.

If you apply from inside Spain on a tourist visa, you receive a 3-year residency permit immediately upon approval.

The Beckham Law Benefit

DNV holders move to Valencia and opt into a special tax regime. Instead of paying the standard progressive income tax (up to 47%), you pay a flat 24% on income earned up to €600,000 for six years. This is arguably the strongest financial incentive in Europe for high-earning remote workers.

How much do I need to earn for the Spain Digital Nomad Visa in 2026?
You need to show 200% of the Spanish minimum wage (SMI), which works out to roughly 2,849 EUR per month gross or 34,188 EUR per year in 2026. The UGE-CE accepts payslips for salaried remote workers or 3 months of invoices and bank statements for autonomos. If you bring a spouse, add 75% of SMI; for each minor child, add 25% more. Bonuses count if they appear in the contract; one-off freelance gigs do not.
Can I switch from a tourist Schengen stamp to the DNV without leaving Spain?
Yes, and that is the route most expats take. If you apply from inside Spain on a 90-day Schengen entry, the UGE-CE in Madrid issues a 3-year residency authorization directly, instead of the 1-year permit you get from a consulate abroad. You still need to be in legal status when you submit, so file before day 90. Once approved, you book biometrics and receive the TIE card 4 to 6 weeks later.
How long does the UGE-CE take to decide a DNV application in 2026?
Legally the UGE has 20 working days, but the realistic average in early 2026 is 25 to 35 working days for clean files. Files with a subsanacion request (missing apostille, sworn translation, etc.) reset the clock and can stretch to 8 to 10 weeks. The fastest cases we have seen approved this year sat at 14 days. The slowest, with subsanacion, took 11 weeks. Submit a complete dossier and the timeline is predictable.
Does the DNV automatically give me the Beckham Law 24% flat tax?
No, it makes you eligible, but you must opt in. You file Modelo 149 within 6 months of registering with Spanish Social Security or your DNV start date, whichever comes first. Miss the window and you fall back to progressive IRPF (up to 47%) for your entire stay. Beckham then locks in 24% flat on Spanish-source income up to 600,000 EUR, with 47% above that, for 6 years total (the year of arrival plus 5).
Can I include my spouse and children in the same DNV application?
Yes. The DNV explicitly allows family reunification in a single file: spouse or registered partner, minor children, and dependent adults (parents) if you can show you support them financially. You must prove an extra 75% of SMI for the first family member and 25% per additional dependent. So a couple with one child needs roughly 2,849 + 2,137 + 712 = around 5,698 EUR per month. Apostilled marriage and birth certificates plus sworn translations are mandatory.
How does the DNV renewal work after the first 3 years?
The first DNV authorization is valid for 3 years. Before it expires, you renew for 2 more years (a 3+2 structure). After 5 years of legal residency you become eligible for long-term EU residency, which is permanent and renewable every 5 years without the income test. Renewal requires showing you still meet the income threshold and that you have not spent more than 6 months outside Spain per year. File 60 days before expiry.
